Wingua Terms of Service
1. Agreement
By creating an account, signing in, or using Wingua, you agree to these Terms of Service and our Privacy Policy (together, the “Terms”). If you do not agree, do not use the service.
2. The service
Wingua provides AI-assisted language and social coaching (including text and, where enabled, analysis of images or camera input you choose to share). Coaching outputs are generated using third-party AI models (including OpenAI) as described in our Privacy Policy. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Eligibility and accounts
You must be at least 16 years old (or older where local law requires a higher minimum age, including the age required to lawfully enter a binding contract or consent to data processing in your jurisdiction) to use Wingua. By creating an account or using the service you confirm that you meet the minimum age. You are responsible for account credentials and for activity under your account. Notify us if you suspect unauthorized access.
You must not use Wingua to capture, upload, or analyze imagery of minors, undressed individuals, identifying documents, or anyone who has not consented to be photographed. You are solely responsible for complying with the consent, privacy, and recording laws of the country and venue you are in.
4. Subscriptions and payments
Paid features (“Wingua Plus” or similar) are billed through Apple App Store or Google Play as applicable. Prices, renewal, and cancellation follow the platform’s rules. To the extent allowed by law, fees are processed by the platform; refund requests are handled per Apple/Google policies.
5. Acceptable use
You agree not to: (a) use Wingua for unlawful, harmful, deceptive, or harassing purposes; (b) attempt to reverse engineer, scrape, or overload our systems; (c) submit content you do not have rights to share, or that infringes others’ rights; (d) circumvent paywalls, quotas, or security. We may suspend or terminate access for violations.
6. Your content
You retain rights to content you provide. You grant us a limited license to host, process, and display that content solely to operate and improve the service (including model-assisted processing as described in our Privacy Policy). You represent you have the rights needed to grant that license.
7. AI limitations and disclaimer
Outputs are generated by artificial intelligence (including services provided by OpenAI) and may be inaccurate, incomplete, or inappropriate for a given situation. Wingua is not a substitute for professional advice (legal, medical, financial, or otherwise). You use suggestions at your own judgment, especially in real-world social or safety-sensitive contexts. How we process content you submit (including photos) is described in our Privacy Policy.
8. Intellectual property
Wingua’s name, branding, software, and materials are owned by us or our licensors. Except for the limited rights to use the app as offered, no rights are granted.
9. Third-party services
The app relies on third-party services to operate, including without limitation: Supabase (authentication and backend), OpenAI (AI processing of text and images you submit for coaching), RevenueCat (subscriptions), cloud hosting for our API, and Apple / Google (app distribution and in-app purchases). Their terms and privacy practices may apply in addition to ours. See our Privacy Policy for a fuller description of how we share information with service providers.
10. Termination
You may stop using Wingua at any time. We may suspend or terminate access for breach of these Terms, risk, or legal requirements. Provisions that should survive (e.g. disclaimers, limits, disputes) survive termination.
11. Disclaimer of warranties
To the maximum extent permitted by law, Wingua is provided “as is” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of Wingua. Our aggregate liability for claims relating to the service shall not exceed the greater of (a) amounts you paid us for the service in the twelve months before the claim or (b) one hundred U.S. dollars (USD 100), except where prohibited by law.
13. Indemnity
You will defend and indemnify us against third-party claims arising from your content or your misuse of the service, to the extent permitted by law.
14. Changes
We may update these Terms. We will post the updated version and update the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using Wingua.
